ASBN Calls EPA Endangerment Finding Repeal ‘Economic Sabotage’ That Threatens Businesses’ Long-term Planning and Investments

WASHINGTON, D.C. – The Environmental Protection Agency (EPA) proposal to repeal the 2009 Endangerment Finding represents a significant threat to American economic stability and our nation’s future competitiveness. The American Sustainable Business Network objects to this attempt to undermine the proven scientific and legal foundations for clean air regulations. From a business perspective, this action is profoundly destabilizing and runs counter to the principles of a predictable and reliable regulatory environment.

The Endangerment Finding is the scientific finding that six key greenhouse gases “threaten the public health and welfare of current and future generations.” The finding follows the 2007 Massachusetts v. EPA Supreme Court decision that greenhouse gases are air pollutants covered by the Clean Air Act. These make up the scientific and legal basis for the EPA to regulate under the Clean Air Act.

American industries depend on regulatory certainty to make long-term capital investments, drive innovation, and create jobs. The Endangerment Finding has provided a clear and consistent framework for over a decade, creating the stability necessary for businesses to invest billions of dollars in clean energy, advanced vehicle technologies, and energy efficiency. This has not only spurred economic growth but has positioned American companies as leaders in the burgeoning global clean-tech market.

“The attempts made to dismantle this framework, and more broadly the attacks on science across the EPA and other agencies, have brought about massive and unnecessary uncertainty into the market,” says Michael Green, ASBN’s Senior Advisor on Climate and Energy Policy. “Undermining the Endangerment Finding would create risk for existing investments and cause chaos, chilling future innovation and discouraging the very investments in technology and infrastructure that are crucial for America’s long-term economic prosperity.”

The EPA’s proposal to repeal the 2009 Endangerment Finding is a reckless and irresponsible decision that would have devastating consequences for businesses and communities across the country. It is a decision that is at odds with the scientific evidence, the law, and the public interest. At a time when the global economy is decisively shifting towards clean energy technologies, this move will cause self-inflicted damage to our nation’s competitiveness. We urge the administration in the strongest possible terms to withdraw this proposal and to reaffirm the EPA’s commitment to protecting public health and the environment from the dangers of climate change.
